Taxpayers Alert! Time Limit for Filing ITR Passed. It is informed to all taxpayers that the due date to file an income tax return (ITR) has ended. Now, if taxpayers want to submit tax returns for the tax year 2022 without penalty, they must have filed an extension up to 15th December 2022.
The last date to file tax returns for salaried, Individuals and AOPs was September 30, 2022. It was then extended for further 3 times from September 30th, 2022 to November 30th, 2022. Afterward, December 15th, 2022 was the last date to file tax returns, and then was not further extended by the Federal Board of Revenue (FBR).
Now, if someone submits his tax return for the tax year 2022 after the due date of December 15, 2022, then he/she has to pay penalty/surcharge for ATL after 1st March 2023. Because FBR issues active taxpayers list on 1st March every year and all those who did not submit their tax returns within the due date will become inactive. Moreover, to update the status to the active taxpayer, late filers must have to pay a penalty also.
After payment of the penalty/ surcharge for ATL, their name will include in the Active taxpayer list (ATL) forthwith.
List of Penalty/ Surcharge for ATL
If a person files tax return after the due date then taxpayers will also pay a penalty as a surcharge for ATL. He can pay this penalty from March 1st, 2023 onward. Because late filers will become inactive in FBR in March 2023. Following is the list of penalties/surcharges for ATL based on the type of taxpayer:
- Salaried, Individual, Rs1,000
- AOPs, / Partnership Businesses, Rs10,000
- Private / Public Limited Companies, Rs20,000
It is further clarified here that last date to file tax return for private / public limited companies is December 31st, 2022.
Once, the late filers pay penalty in March 2023, then their status will be active in FBR, otherwise, their status with FBR will remain inactive even after the submission of the tax return for 2022 after the due date.
How to Become Active Tax filer before 1st March 2023
The deadline for filing tax returns has just ended as of December 15, 2022, for the tax year 2022, now up to the end of February 2023 if someone wants to become an active filer with FBR then they have to file a tax return for the tax year 2021 along with a penalty/surcharge for ATL, for that year. Moreover, if he also files tax return for the tax year 2022 after the deadline passed then he will also pay penalty for 2022 in March 2023.
How to Become Active Tax filer after 1st March 2023
After March 1st, 2023, if someone wants to become an active tax filer then he has to file a tax return for the tax year 2022 instead of the tax year 2021 along with a penalty/surcharge for ATL for that year. Because FBR will issue an updated list of tax filers on March 1st, 2023. So, after 1st March 2023 based on the submission of the tax return for the tax year 2022 any person will become an active filer in FBR after payment of penalty/surcharge for ATL.
